Wrongful death referrs to a situation wherein the death is caused by negligence or intentional harm.

The legal term of wrongful death can be defined as a claim against a person who can be held liable for a death. In some cases, this can be defined as "manslaughter". It may also occur as a result of negligent behaviour or an intentional act.

This type of lawsuit is usually initiated by close friends or relatives against a person who initiated the negligent act resulting in the wrongful death.


Damages for wrongful death do not necessarily amount to more than if the victim were alive. Under common law, the victims do not have the opportunity to recover for losses which have been suffered if the victim were alive.
